In New Jersey, all DUI/DWI charges are handled in municipal court. With over twenty-one years of experience as a defense lawyer, I understand the charges you face and the options you have for minimizing the penalties in regards to all types of drunk driving charges, including those for blood alcohol levels between 0.08 percent and 0.10 percent, and higher than 0.10 percent. These levels carry different penalties and periods of suspended license. I have the experience to help you present a defense to any of these types of offenses to minimize the penalties and therefore the impact on your life.
If you are charged with a second DUI/DWI at any blood alcohol level, you face the additional possibility of jail time. If you are convicted of a third DWI, you will go to jail. I also protect the rights of individuals who have been charged with driving under the influence of drugs and other banned substances.
Drunk driving cases are very technical. New Jersey uses the Alcotest machine to measure blood alcohol content, and it is not uncommon for these machines to have problems. The New Jersey Supreme Court has fairly recently approved the Alcotest machine for use in DUI/DWI prosecutions. There are a number of different scientific and technical things the state has to prove with this test, and you want to make sure you have an experienced lawyer who fully understands these concerns.
New Jersey, in many instances, goes further than even the federal constitution in terms of protecting the rights of people that have been charged with a crime. There are strict search and seizure rules, and we will look at every aspect of your case in order to determine whether or not your rights were violated at any point in the process.
